Our zero-tolerance policy against counterfeit goods is designed to protect the integrity of our platform and ensure a secure and trustworthy environment for all users.

Counterfeit products, fraudulent listings, and deceptive practices undermine the community’s experience, and we are committed to enforcing strict measures to combat this activity.

1. Prohibition of Counterfeit Goods

Collektr strictly prohibits the sale, promotion, or distribution of counterfeit goods, including but not limited to:

Fake branded items such as luxury goods, watches, designer clothing, or sneakers.
Fake trading cards and collectibles (e.g., Pokémon, Magic: The Gathering, and other rare or limited-edition items).
Impersonated artwork, memorabilia, or other high-value collectibles that are misrepresented as authentic or original.
Unauthorized or fraudulent replicas of high-value or limited-edition collectibles.

Any item listed on Collektr that is found to be counterfeit will be immediately removed from the platform. Sellers found violating this policy will face account suspension, permanent bans, and may be subject to legal action.

2. Seller Responsibility and Accountability

Sellers on Collektr are responsible for ensuring that all products listed on the platform are authentic, genuine, and not counterfeit. By listing an item, sellers confirm that:

The item is genuine and accurately represents the brand, manufacturer, or designer.
The item is not misrepresented in any way, including its condition, value, or authenticity.
All relevant documentation or certification proving the item’s authenticity (e.g., certificates of authenticity, purchase receipts, etc.) will be provided upon request.
Sellers must comply with Collektr’s policies regarding intellectual property and trademarks.

Failure to comply with these requirements can lead to penalties, including account suspension, removal of listings, and a permanent ban from Collektr.

3. Buyer Protection and Resolution Process

We understand the importance of buyer trust, and we are committed to protecting buyers from counterfeit goods. If you believe an item you purchased is counterfeit, you are encouraged to take the following steps:

Report the Issue: Contact Collektr’s customer support within 3 days of receiving the item to initiate a dispute. You can reach us by emailing [email protected]. Claims made after this period may not be eligible for Buyer Protection unless exceptional circumstances apply.
Submit Evidence: Buyers may be asked to provide documentation (e.g., photographs, expert authentication reports, etc.) to support the claim that the item is counterfeit.
Refund Policy: If an item is confirmed to be counterfeit, Collektr will provide a full refund to the buyer. The seller will be held financially responsible for the return shipping costs and any additional fees incurred.

In case of disputes, Collektr will make a final determination based on the evidence provided by both parties.

4. Authentication and Verification Process

To further safeguard the community, Collektr may offer or collaborate with third-party authentication services to verify the authenticity of high-value or high-risk items. This applies to, but is not limited to:

Luxury watches, designer goods, and branded apparel.
Rare trading cards (e.g., Pokémon, Magic: The Gathering, etc.).
Artwork and other high-value collectibles.

Sellers may be required to submit documentation or seek third-party authentication before listing certain high-value items. Collektr reserves the right to initiate authentication on behalf of the buyer in cases of suspected counterfeit goods.

5. Reporting Counterfeit Listings

If you come across a listing that you suspect may be selling counterfeit goods, we urge you to report it immediately. You can do this by contacting Collektr’s support team directly at [email protected]. We treat all reports seriously and will investigate suspected counterfeit activity promptly.

Collektr will take appropriate action against sellers found violating the counterfeit policy, which may include:

Immediate removal of the listing.
Suspension or permanent ban of the seller’s account.
Possible legal action in collaboration with intellectual property rights holders.

6. Enforcement and Consequences

Collektr takes swift action against counterfeit listings and deceptive practices. Violations of this policy can result in:

Immediate removal of counterfeit listings.
Temporary or permanent account suspension for sellers engaging in counterfeit activity.
Legal action may be taken in cases where counterfeit goods are being sold, including involvement of intellectual property rights holders or law enforcement agencies.
Loss of platform privileges, including the ability to list items or engage in auctions.

Collektr actively monitors all listings and transactions to detect fraudulent activity. Any attempt to manipulate or deceive buyers, either through counterfeit goods or misrepresentation, will not be tolerated.

7. Legal Compliance and Cooperation

Collektr operates in full compliance with local and international laws, including intellectual property laws, anti-counterfeiting regulations, and consumer protection standards. In cases of counterfeit activity, Collektr will:

Cooperate with law enforcement and intellectual property enforcement bodies when necessary.
Provide information to rights holders or relevant authorities if required by law.
Remove counterfeit goods and work with legal entities to protect the rights of creators and trademark holders.

8. Off-Platform Counterfeit Activity

In rare cases, Collektr may take action against users engaged in off-platform activities that threaten the integrity of the platform, including the sale of counterfeit goods or fraud across other websites or marketplaces. Evidence of such activity may lead to penalties, including account suspension or permanent ban from Collektr.
